Acceptance of these terms

These Terms of Service ("Terms") govern your use of https://www.acemedicalsup.com (the "Site"), operated by Ace Medical Supplies LLC ("Ace Medical Supplies," "we," "us"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Not medical advice; emergencies

Information on the Site, including product descriptions, guides and articles, is for general information only. It is not medical, legal or insurance advice and is not a substitute for the advice of your physician, therapist or other qualified professional. Always follow your health care provider's instructions about which equipment is appropriate for you and how to use it.

The Site is not for emergencies. Do not use our forms, email or text messages for urgent medical needs. If you have a medical emergency, call 911.

Insurance and coverage

Any information about Medicare, Medicaid, private insurance or workers' compensation coverage is general and may not apply to your plan. Coverage, eligibility and your costs are determined by your plan and are subject to verification. Listing a plan on the Site does not guarantee that we are in network for your specific plan or that a particular item will be covered. We will verify your benefits and tell you about any expected costs before delivery whenever possible, but payers make final coverage decisions, and you may be responsible for amounts your plan does not pay, as allowed by law and your plan.

Products, availability and pricing

Product photos and descriptions are representative. The make, model, color and features of the equipment you receive may differ from what is pictured, based on your prescription, your insurance and availability. All products are subject to availability. Any prices shown are subject to change and do not apply to insurance-billed orders unless stated.

Orders, rentals and delivery

• Equipment orders, rentals and purchases are subject to our separate patient intake documents, which may include an assignment of benefits, rental agreement, delivery ticket and financial responsibility forms. Those documents control if they conflict with these Terms.
• Delivery times, including same-day delivery, are estimates and are not guaranteed. They depend on order time, location, product availability and completion of required paperwork and insurance verification.
• Local delivery and in-home set-up are available in Broward, Miami-Dade and Palm Beach counties. Orders elsewhere in Florida, and workers' compensation orders outside Florida, may be shipped. Some items may not be available for shipping.
• Rental equipment remains our property unless ownership transfers under your plan's rules or your rental agreement, and must be returned in good condition, reasonable wear excepted, when the rental ends.

Referrals and submissions

• By submitting a referral or verification request about another person, you confirm that you are authorized to share that person's information with us for the purpose of providing medical equipment and related services, and that the information is accurate to the best of your knowledge.
• Submitting a form does not create an order or guarantee that equipment will be provided. We will contact you or the patient to confirm details, coverage and delivery.
• Do not upload files that contain viruses or anything other than information needed for the referral.

Payments

Online payments are processed by a third-party payment processor on its own secure website and are subject to that processor's terms. Questions about a charge on your statement can be directed to us at 954-332-4378.

Acceptable use

You agree not to misuse the Site, including by submitting false information, attempting to gain unauthorized access to our systems, interfering with the Site's operation, or using automated means to collect content from the Site.

Content and trademarks

The Site's design, text, graphics and logos, including the Ace Medical Supplies name and AMS logo, are owned by us or used with permission, and may not be copied or reused without our written permission. Product names, brands and images belong to their respective manufacturers and owners and are used to identify the products we supply.

Links to other websites

The Site may link to third-party websites, such as payment processors, manufacturers, maps and review sites. We are not responsible for their content, policies or practices.

Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties regarding the Site, express or implied, including accuracy, completeness and fitness for a particular purpose. This does not affect any manufacturer warranties on the equipment you receive or any rights you have that cannot be waived under law.

Limitation of liability

To the fullest extent permitted by law, Ace Medical Supplies will not be liable for any indirect, incidental, special or consequential damages arising from your use of, or inability to use, the Site or information on it. Nothing in these Terms limits liability that cannot be limited under applicable law.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute relating to the Site will be brought in the state or federal courts located in Broward County, Florida, unless applicable law requires otherwise.

Changes

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Site after changes means you accept the updated Terms.
